Under the current law, if you wish to claim damages for personal injuries sustained in an accident, then you must bring the claim within 3 years of the date of that accident. However, if you were under 18 years of age at the date of the accident, then you will have until your 21st birthday in which to bring your claim, irrespective of the accident date.

 

 

Road Traffic Accident

If you were a pedestrian, passenger or driver in a road traffic accident in the last three years that was not your fault, and you have sustained injuries as a result of that accident, then you may be entitled to claim compensation for your injuries, and for financial losses incurred by you as a result of the accident.
 


Tripping

Local Authorities are under a legal duty to maintain the highway at public expense. If the Local Authority have failed to discharge that duty, and a defect in the highway has caused you to trip or fall in the last three years, then you may be able to claim compensation for your injuries from the Local Authority.

Criminal Injury

If you have been injured as a result of an assault or a criminal activity in which you were not committing an offence, an application can be made to the Criminal Injuries Compensation Authority (CICA) who may award you damages in respect of those injuries, subject to certain criteria. Public Funding from the Legal Services Commission may be available to fund the costs of making such a claim.

Fatal Accidents

If a family member or dependent has been fatally injured as a result of an accident which was not their fault, then you may be able to claim compensation for your bereavement and loss of dependency.

Industrial Injury and Diseases

Employers are under a legal duty to ensure that stringent Health & Safety regulations are adhered to in the workplace. If your employer has failed to implement the necessary safeguards and this has resulted in you sustaining an injury or developing a disease, then you may be able to claim compensation from your employer in respect of your injury and associated losses.
